2. Eligibility

You must:

Have the legal capacity to enter into contracts

Use the Services only in accordance with these Terms and applicable laws, including TCPA, CAN-SPAM, and other telecommunications regulations

3. Account Registration

Clients must provide accurate and current information when creating an account.

You are responsible for maintaining the confidentiality of your account credentials.

You are responsible for all activities conducted through your account.

Unauthorized use must be reported immediately.

4. Acceptable Use

You agree not to use the Services to:

Send spam or unsolicited communications

Violate any federal, state, or local laws

Transmit harmful or illegal content

Circumvent our technical or security measures

Harass, defraud, or abuse recipients

Failure to comply may result in immediate suspension or termination of Services.

5. Consent and Compliance

Client Responsibility: Our clients are solely responsible for obtaining and managing end-user consent for all communications (SMS, voice calls, or other messages).

Platform Enforcement: Eleven Solutions enforces compliance via Do Not Call (DNC) lists, call frequency limits, and opt-out mechanisms.

Users may opt out of communications by replying STOP for SMS or requesting removal from voice calls.

6. Fees and Payment

Clients are responsible for all applicable fees for the Services, including subscription charges, message, and call fees.

Fees are billed as described in your account agreement.

We may suspend Services for non-payment or billing issues.

7. Intellectual Property

All content, software, trademarks, logos, and materials associated with Eleven Solutions are owned by us or our licensors.

You may not copy, modify, distribute, or use our intellectual property without written permission.

8. Limitation of Liability

No Warranty: The Services are provided “as is” and “as available.”

Limitation: To the maximum extent permitted by law, Eleven Solutions LLC is not liable for any indirect, incidental, special, or consequential damages arising from the use of our Services.

Cap: Our total liability will not exceed the amount paid by you for the Services in the 12 months prior to the claim.

You agree to indemnify, defend, and hold harmless Eleven Solutions LLC, its officers, employees, and agents from any claims, liabilities, damages, and expenses arising from:
